CosmoQueen - General Terms and Conditions Version: December 20081. General 1.1. These general terms and conditions apply to all agreements relating to online orders between CosmoQueen and Customer. Unless expressly agreed otherwise, the application of other general terms and conditions is excluded. 1.2. CosmoQueen is entitled at all times to amend these general terms and conditions and the contents of its website. Customer is only bound by these general terms and conditions after he/she has made the appropriate tick as acceptance of the validity hereof during the order process. 2. Offers and Agreements 2.2. The purchase agreement between CosmoQueen and Customer will be concluded when Customer accepts the offer and complies with the associated conditions electronically. CosmoQueen.nl shall immediately confirm receipt of the acceptance of the offer electronically. As long as receipt of this acceptance has not been confirmed, Customer may terminate the agreement. CosmoQueen is entitled to terminate the agreement if it has good reasons to believe that Customer cannot or will not be able to comply with its obligations. CosmoQueen shall give notice, and supply reasons, within 10 days after receipt of an order if the order is not accepted or if further conditions are being attached thereto. 2.3. Customer may order the products offered by CosmoQueen on the website and have these delivered to a home or other delivery address. 2.4. CosmoQueen shall start production of the order as soon as possible after the order is made final. Customer may only cancel the order or terminate the agreement by contacting CosmoQueen telephonically during office hours. CosmoQueen will consider on a case-by-case basis, taking into account the status of the order, whether cancellation is still possible. 3. Prices and Payment 3.2. The price that is stated in the confirmation e-mail is binding, subject to the provisions of 3.1. 3.3. Payment takes place by means of the payment methods offered on the website. Customer must pay all orders according to the payment method(s) offered by CosmoQueen. 3.4. Prices are in euros and are clearly indicated on the website. The indicated prices include VAT and delivery costs. If the cost of packages being sent abroad exceeds €12.50, CosmoQueen will recover the additional costs afterwards. 4. Door-to-Door Delivery of Ordered Products 4.2. If the cost of packages being sent abroad exceeds €12.50, CosmoQueen will recover the additional postage costs afterwards. This amount depends on the quantity of products ordered and will be communicated to Customer within 24 hours of receipt of the order by CosmoQueen. 4.3. CosmoQueen bears the risk of products ordered by Customer during transport. Once the products are delivered, or can reasonably be deemed delivered, risk in the products passes to Customer, subject to any liability that CosmoQueen cannot legally exclude. 4.4. CosmoQueen shall endeavour to present the orders that Customer orders before noon on Mondays to Fridays (inclusive) to TPG Post within 3 days. TPG Post shall endeavour to deliver the ordered products to Customer on the next working day. 4.5. Customer may have the products ordered from CosmoQueen delivered to his/her home address or another designated address. The delivery address is the address stipulated by CosmoQueen in the confirmation e-mail. 4.6. If an order that has been sent by CosmoQueen is not delivered to Customer, CosmoQueen will wait two weeks for domestic packages and at least four weeks for foreign packages, before executing the order again. No exception will be made to these waiting periods. 4.7. CosmoQueen recommends that the delivered product(s) be inspected immediately after delivery and that any apparent defects be communicated in writing within an appropriate period. 5. Cooling-Off Period for Products Delivered Door-to-Door 5.2. If Customer wishes to terminate the agreement on the basis of the provisions of Article 5.1, he/she must notify CosmoQueen of that fact in writing (by means of the response form on the website) or telephonically. Customer may return the products to CosmoQueen. 5.3. If Customer has already made payments at the time he/she rescinds the agreement with CosmoQueen, CosmoQueen shall reimburse these payments to Customer within 30 (thirty) days of receipt of the goods returned by post or in person by Customer. 5.4. CosmoQueen reserves the right to refuse goods returned by post or in person, or to only reimburse part of the amount paid, if it suspects that the products have been opened, used or damaged through fault of Customer (as opposed to its own fault or that of the supplier of the products). 5.5 If CosmoQueen is of the opinion that the product returned to it has been damaged due to Customer’s acts or omissions, or that the damage is otherwise for Customer's risk, it shall notify Customer thereof. CosmoQueen is entitled to deduct the reduction in value of the product as a result of this damage from the amount to be reimbursed to Customer. 6. Complaints 7. Miscellaneous 7.2. CosmoQueen provides the following information, among other things, via
the website: 7.3. CosmoQueen endeavours to make sure that the information on the website is as accurate, complete and clear as possible. Products may however differ slightly from the pictures on the website. 7.4.
